Kevin O'Leary's wife charged in fatal Ontario boat crash

Gary Poltash, 64, was killed in the crash while a 48-year-old woman, Susanne Brito, of Uxbridge, was critically injured.

A rep for Kevin told TMZ that Linda had been driving the boat at the time of the crash and that she was administered a DUI test the night of the accident and passed.

In a news release issued on Tuesday afternoon, police confirmed that Linda O'Leary has been charged with careless operation of a vessel under the Canada Shipping Act.

Another passenger, 57-year-old New Yorker Richard Ruh, has also been charged, with Failing to Exhibit Navigation Light while Underway, which breaks the Canada Shipping Act's Collision Regulations.

O'Leary is scheduled to appear in Parry Sound court on October 29 to answer to the charge.

A lawyer for Linda tells the Canadian Press the accident was "a awful tragedy", but added, "we find it regrettable that the OPP has chosen to charged Mrs".

A NY man who was driving the other boat was also charged in connection with the incident.

Ruh did not immediately respond to a request for comment.

O'Leary did, however, say that the crash "devastated" him, and sent "heartfelt prayers and condolences" to the victims and their families.

O'Leary, a businessman and former Dragons' Den star on CBC, made a bid for the federal Conservative leadership race before dropping out in 2017.

This is a lesser charge and will not require a court appearance, police said.
